 WSIB Mandatory Coverage for Partners or Executive Officers - CONSTRUCTION
 

In our previous Newsletters and seminars we reminded construction employers that under the Workplace Safety and Insurance Act, 1997 (WSIA) and effective January 1st, 2013, compulsory coverage extends to independent operators, sole proprieties, partners and executive officers in the construction industry, with some exemptions.

  • The individual must be a partner or executive officer. (This would not apply to an independent operator).

  • The Partner or executive officer does not engage in any construction work.


WSIB has now posted on their web site two employer forms.


  1. Partner or Executive Officer in Construction - Exemption from Coverage


  2. Request for Rate Group 755, Non-Exempt Partner and Executive Officers in Construction

The first form is to exempt one partner or executive officer (e.g. corporations with more than one executive officer). The executive to be exempt must not perform construction work. WSIB defines construction work as any manual work of a skilled or unskilled nature, the operation of equipment or machinery, or the direct on-site supervision of workers. Periodic site visits are permitted provided the partner or executive officer is not performing construction work on the site.

 

The second form is to add a partner or executive officer for coverage. If you have been previously exempting the owner (e.g. corporations with one executive officer) on your WSIB reconcillation report, coverage will now be mandatory under rate group 755 which at this time is $0.21 per $100 of payroll to the maximum WSIB insurable earnings ceiling.

 

The completed forms are to be submitted directly to WSIB by January 1st, 2013. WSIB is to provide further direction on completing the yearly reconcillation report, normally due by March 15th of each year. The WSIB reserves the right to determine who is an Executive officer by reviewing the individual's roles, responsibilities and authority within the organization.
